Shoalhaven City Council PROPOSED MODIFICATION OF APPROVED REGIONAL DEVELOPMENTMA2025/1009 The following Application has been received by Shoalhaven City Council seeking approval for: Proposal: Proposed minor modification of approved subdivision RA21/1003. Reconfiguration of 6 lots (no additional lots) with approved stage 4, minor realignment of road 19 to match proposed modification on adjoining land under SF10804 and DS23/169. Property: 41A Main Road BADAGARANG - Lot 1 DP 1289976 Applicant: The Trustee for NewPro 23 Unit Trust Consent Authority: Shoalhaven City Council Determining Authority: Regional Planning Panel - Southern The proposed development as outlined above is a modification application to a Regional Development having regard to clause 3, Schedule 7 of the State Environmental Planning Policy (State and Regional Development) 2011, being Council related development that has a capital investment value of more than $5 million. The proposed development is also Nominated Integrated Development under Section 4.46 of the Environmental Planning and Assessment Act 1979. Approval for the development is required from Natural Resources Access Regulator (NRAR), NSW Rural Fire Service, Transport for NSW and Heritage NSW under the Environmental Planning and Assessment Act, 1979, in respect of: A Controlled Activity Approval is required from Natural Resources Access Regulator (NRAR) under Section 91 of the Water Management Act 2000. A Bush Fire Safety Authority is required from NSW Rural Fire Service under Section 100B of the Rural Fires Act 1997. Consent is required from Transport for NSW under Section 138 of the Roads Act 1993. An Aboriginal Heritage Impact Permit is required from Heritage NSW under Section 90 of the National Parks and Wildlife Act 1974. The application and associated documents can be accessed on Councils website www.shoalhaven.nsw.gov.au by following the Development Application Tracking link (Track a DA) from 15 February 2025 to 17 March 2025. Any person during the above exhibition period may make a submission in relation to the development application detailing reasons for objection or support (making reference to MA2025/1009).
