Seymour Whyte Constructions Pty Ltd and Downer EDI Works Pty Ltd have entered into an Enforceable Undertaking with the EPA following three unlicensed discharges of sediment laden waters. Seymour Whyte Constructions Pty Ltd and Downer EDI Works Pty Ltd are a joint venture undertaking the Berry to Bomaderry Upgrade of the Princes Highway, as the Downer Seymour Whyte Joint Venture (the DSWJV). Seymour Whyte Constructions Pty Ltd and Downer EDI Works Pty Ltd have entered into an Enforceable Undertaking with the Environment Protection Authority (EPA) following an investigation by the EPA into alleged breaches of the s 64 and s 120 of the Protection of the Environment Operations Act 1997. This alleged water pollution and licence breach offences to three separate unlicensed discharges of sediment laden water into and around Tullian Creek near Bomaderry on 19 August 2019 and 17 September 2019. These incidents were self-reported by DSWJV to the EPA. These alleged offences resulted in turbid water being discharged into Tullian Creek causing an increase of turbidity. Turbid water may cause harm to the environment. The Enforceable Undertaking requires Seymour Whyte Constructions Pty Ltd and Downer EDI Works Pty Ltd to: (a) Deliver erosion and sediment control training to staff; (b) Increase the frequency of internal audits on critical controls from six monthly to quarterly; (c) Pay to Shoalhaven City Council $5,00 towards waterway restoration works in the Abernethys Creek catchment; (d) Provide workers to work with a local Bushcare group to enhance the local environment; (e) Submit a report to the EPA on completion of its obligations under the Enforceable Undertaking; and (f) Pay the EPA's legal and investigation costs of $9,500 and reasonable costs of monitoring compliance with the Enforceable Undertaking. This notice was placed was a requirement of the Enforceable Undertaking.
